Proposed regulations in Nevada aim to protect outdoor workers from wildfire smoke without restricting small businesses, per the Division of Industrial Relations (DIR). Under legislation (S.B. 260) signed by Gov. Joe Lombardo, DIR must establish guidelines by January 1 for employers with 10+ employees based on the Air Quality Index (AQI). Specific measures are required as the AQI rises, including prohibiting critical outdoor tasks when it reaches 200 or higher.

DIR consulted small businesses through questionnaires and a public meeting. While some costs may arise from the regulations, benefits include reduced employee injuries and lower health care costs. Many small businesses already follow similar safety standards in California. Key requirements include a written safety program, training for supervisors, and providing N95 masks. The regulations will take effect upon filing with the Nevada Secretary of State.
