Berkshire Hathaway’s PacifiCorp is appealing a 2023 jury verdict in a wildfire class-action case that may cost the company billions. Blamed for wildfires in Oregon in September 2020, PacifiCorp was found grossly negligent for not shutting off power during high-risk conditions. The jury awarded $645 million to 119 victims, with potential damages exceeding $6.45 billion, impacting the company’s bondholders and credit rating.

During the Oregon Court of Appeals hearing, PacifiCorp argued that the case should not have been treated as a class action due to differences among property owners affected. Victim lawyers contended that the trial judge’s decision to group claims was justified. PacifiCorp also claims an Oregon statute restricts non-economic damages, but plaintiffs maintain the awards for emotional distress are legally valid. A ruling from the appeals court is expected within six months to a year.
